What does Dailymotion do?

Dailymotion is a French video sharing platform operated by Dailymotion SA (Vivendi group). The embedded Dailymotion Player sets cookies for analytics and advertising and loads US ad partners. EU first hosting but consent is required.

What Dailymotion is

Dailymotion is one of the largest European video sharing platforms. Operated by Dailymotion SA in Paris and owned by Vivendi (Canal+ group), the platform hosts user generated and editorial video, monetises it through programmatic advertising and offers a publisher embed (the standard Dailymotion Player) and a premium offering for publishers (Player Pro). The platform has a French legal entity, French DPO and primary EU hosting.

Cookies set by the Dailymotion Player

The embedded player sets several cookies on the dailymotion.com domain: ts and ts_c (1 year, session and consent state), ff (1 year, feature flags), x1.cid and x1.uid (1 year, user identification used for audience and advertising), v1 (session, player state), s_session_id (session, session identifier) and qos (session, quality of service). The player also loads third party tags from Google Ad Manager, Magnite (formerly Rubicon), Index Exchange and several SSPs, which set their own cookies.

GDPR, ePrivacy and the French context

All Dailymotion Player cookies fall under ePrivacy art. 5(3): prior consent is required, even for the audience measurement cookies because Dailymotion combines them with advertising. The CNIL has a 2022 deliberation on video embeds that explicitly requires consent for the Dailymotion ecosystem. As a French company Dailymotion follows the IAB Europe TCF v2.2 specification and supports the Google Consent Mode signal. Joint controllership under GDPR art. 26 applies between the publisher and Dailymotion SA for the audience data shared with the platform.

Data residency and US ad partner transfers

The core Dailymotion platform runs in the EU (France and Google Cloud Belgium and Netherlands). However the embedded player loads tags from Google Ad Manager, Magnite, Index Exchange, OpenX and other SSPs, most of which are US headquartered and transfer the IP and the cookie ID to the United States. These transfers happen even on an EU only Dailymotion deployment because the ad partners are loaded client side at play time. Player Pro lets you disable ads to remove that surface.

How to embed Dailymotion compliantly

Use a click to load wrapper, integrate with a TCF v2.2 CMP that signals consent to Dailymotion, prefer Player Pro without ads for premium content, configure the player privacy mode to defer cookies until consent, list the cookies in the privacy notice including the ad partner cookies, sign the joint controllership essence with Dailymotion SA and route DSAR through the Dailymotion DPO contact in Paris.

GDPR consent category

Preferences

Websites using Dailymotion must obtain user consent under GDPR regulations.

Legal basisConsent under GDPR art. 6(1)(a) and ePrivacy art. 5(3) for the Dailymotion Player cookies (ts, ts_c, ff, x1.cid, x1.uid), the Audience Measurement, the advertising tags loaded by the player and the access to playback resume data. Player Pro with the no ads embed and a private video token can be deployed with reduced consent surface but the player itself still writes cookies, so consent remains required.

Applicable regulationsGDPR, ePrivacy Directive, CNIL recommendation on cookies (2020), Audiovisual Media Services Directive (AVMSD), French Loi Informatique et Libertés, EDPB guidelines 2/2023, Digital Services Act, EU US Data Privacy Framework for embedded advertising

DPIA considerations

A DPIA is recommended for any Dailymotion embed because the standard player loads multiple ad partners and an audience measurement script. The DPIA should document the cookies set by the player, the advertising ecosystem (Google Ad Manager, Magnite, Index Exchange), the IAB TCF v2.2 signal, the option of Player Pro without ads, the integration with the publisher CMP and the retention of the visitor audience profile that Dailymotion builds on its own properties.

Sample consent text

We embed videos via Dailymotion, a French video platform operated by Dailymotion SA (Vivendi group). The Dailymotion Player sets cookies (ts, ts_c, ff, x1.cid, x1.uid) and loads third party advertising scripts (Google Ad Manager, Magnite, Index Exchange) that may transfer your data to the United States under the EU US Data Privacy Framework. You can accept, refuse or withdraw at any time. Refusing displays a static poster with a click to load button.

Technical details

Server locationDailymotion is operated by Dailymotion SA, a French company headquartered in Paris and majority owned by Vivendi (now Canal+). The platform runs on a hybrid infrastructure of Dailymotion owned data centres in France and Google Cloud Platform regions europe-west1 (Belgium) and europe-west4 (Netherlands). Video files are delivered through the Dailymotion edge network with European points of presence prioritised. The Dailymotion Player and the Player Pro use the dailymotion.com and dmcdn.net domains.
Data transferred outside the EUDailymotion is a European company under French jurisdiction, so the base storage and processing stay in the EU. However the standard Dailymotion Player loads third party advertising scripts (Google Ad Manager, Magnite, Index Exchange, etc.) that transfer the IP and the device data to US ad networks. The Dailymotion ad sales team operates from Paris, New York and Singapore. Vivendi (parent company) shares some operational tooling globally.

Frequently asked questions

What cookies does Dailymotion set?

The Dailymotion Player sets ts, ts_c, ff (1 year each), x1.cid, x1.uid (1 year, audience and advertising), v1 (session, player state), s_session_id (session) and qos (session, quality of service). Third party ad partners loaded by the player (Google Ad Manager, Magnite, Index Exchange) set their own cookies on the visitor browser.

Is consent required for Dailymotion?

Yes. All Dailymotion Player cookies require prior consent under ePrivacy art. 5(3) and GDPR art. 6(1)(a). The CNIL 2022 deliberation on video embeds confirms this. Player Pro without ads has a smaller surface but still writes cookies, so consent remains required.

What is the legal basis for Dailymotion?

Consent (GDPR art. 6(1)(a)) for the player cookies and the audience match. Joint controllership under art. 26 between the publisher and Dailymotion SA for the shared audience data. The ad partners loaded by the player have their own legal basis (consent for behavioural advertising).

Are data transferred to the United States?

The Dailymotion core runs in the EU. However the standard player loads US ad partners (Google Ad Manager, Magnite, Index Exchange) that transfer the visitor IP and ID to the US. Player Pro without ads keeps the data in the EU. EU US Data Privacy Framework applies to the embedded ad partners.

Do I need a DPIA for Dailymotion?

Recommended for the standard player because of the advertising ecosystem loaded. The DPIA should document the player cookies, the ad partner chain, the IAB TCF v2.2 integration, the joint controllership and the EU US transfers triggered by the ad SDKs.

How do I embed Dailymotion compliantly?

Use a click to load wrapper, integrate with a TCF v2.2 CMP, prefer Player Pro without ads for premium content, enable the player privacy mode to defer cookies, list all cookies in the privacy notice, publish the joint controllership essence and route DSAR via the Dailymotion DPO in Paris.

What are the alternatives to Dailymotion?

EU first video: PeerTube (federated, self hosted), Bunny Stream (Slovenia), JW Player Cloud with EU hosting, Vimeo (US with EU hosting), Bitmovin (Austria), Kaltura (Israel with EU hosting), Cloudflare Stream and Brightcove (US with EU residency). Self hosting raw HLS on a CDN is the simplest privacy first option.

How do I update my cookie policy after adding Dailymotion?

List Dailymotion SA as a joint controller, declare the player cookies (ts, ts_c, ff, x1.cid, x1.uid, v1, s_session_id, qos) with retention, mention the ad partners loaded by the player, disclose US transfers via the partner ecosystem, link to the Dailymotion Privacy Center and offer a permanent withdrawal of consent.
