LayUp
LayUp is a South African lay by payment service from LayUp Technologies in Cape Town: shoppers pay a deposit and then instalments, and receive the goods once the plan is paid off. Merchants integrate it server side through an API or WooCommerce and Magento modules, then redirect the shopper to LayUp's hosted payment widget. It sets no cookies on the merchant site, but order and identity data travel to South Africa. It is unrelated to layupcloud, the Layup learning platform.
What does LayUp do?
What LayUp is
LayUp is a digital lay by service run by LayUp Technologies, a fintech company based in Cape Town, South Africa. Instead of buying now and paying later, the shopper pays a deposit, then settles the balance in instalments, and the merchant ships the goods once the plan is fully paid. Merchants pay a fee per payment plan created and integrate LayUp through a REST API, or through the official WooCommerce and Magento modules. Orders are then held in a partial payment state until the plan completes.
A note on naming: searches for layupcloud or Layup cloud usually concern Layup, a separate gamified employee learning platform whose login portal runs on layupcloud.com. That product has nothing to do with the LayUp payment service described on this page.
Data and cookies it collects
The integration is server side. The merchant's backend creates an order through the LayUp API with the order amount, products and the customer's contact details such as name, email and mobile number. The shopper is then redirected to the hosted payment widget on shopper.layup.co.za, where they sign in or register, choose a plan and pay by card or instant EFT; card payments are handled by Peach Payments. LayUp sends status updates back to the merchant through webhooks.
Because nothing is embedded in the merchant's pages, LayUp sets no cookies on the merchant site. The hosted widget, which is LayUp's own domain, loads Google gtag, Cloudflare Turnstile bot protection and the Peach Payments checkout, so the shopper may receive analytics and security cookies there. Those are LayUp's responsibility rather than the merchant's.
GDPR and ePrivacy implications
For a European merchant, LayUp mainly raises GDPR questions rather than cookie questions. The data shared is personal data, and LayUp most likely acts as an independent controller for the shopper's account and payment plan, as payment providers usually do. The merchant must inform shoppers in its privacy notice that choosing LayUp shares their data with a South African provider. Art. 5(3) of the ePrivacy Directive, the CNIL rules, TDDDG ยง 25 and LSSI CE art. 22.2 are not triggered on the merchant site, since nothing is stored on or read from the visitor's device there.
Consent requirements
No cookie consent is needed for LayUp on the merchant site. Sharing order and contact data with LayUp when the shopper actively selects it at checkout is necessary to perform the contract the shopper asked for, so Art. 6(1)(b) GDPR applies. Do not bundle LayUp into a consent banner category; it would make a payment method depend on a cookie choice for no legal reason.
Data transfers outside the EEA
South Africa has data protection legislation, the Protection of Personal Information Act (POPIA), but no adequacy decision from the European Commission. Transfers to LayUp and Peach Payments therefore need a Chapter V mechanism. Where the shopper chooses LayUp, the transfer is generally necessary for the contract under Art. 49(1)(b) GDPR, but for repeated, systematic flows SCC 2021/914 are the more robust route. LayUp's web properties also rely on Cloudflare, Amazon Web Services and Google, which can involve the United States.
Practical compliance steps
Mention LayUp in your privacy notice as a payment provider based in South Africa, with the categories of data shared and a link to LayUp's own policy. Ask LayUp for its data processing terms, confirm its role and whether it runs credit or affordability checks, and document the transfer basis. Keep LayUp out of your cookie banner, but verify with a scan that your WooCommerce or Magento theme does not load LayUp assets on product pages. Finally, describe lay by orders in your terms so shoppers understand when their data is shared.
LayUp and the GDPR
- Legal basis
- Performance of a contract (Art. 6(1)(b) GDPR) for sharing order and customer data with LayUp when the shopper chooses lay by checkout. No cookie consent is needed on the merchant site because the integration sets no cookies there; analytics cookies on LayUp's own hosted widget fall under LayUp's responsibility as a separate controller.
- Risk level
- medium
- Applicable regulations
- GDPR (Art. 6(1)(b), Chapter V transfers), ePrivacy Directive 2002/58/EC art. 5(3) (not triggered on the merchant site), South African Protection of Personal Information Act (POPIA), PCI DSS for card payments
Impact assessment (DPIA)
A DPIA is usually not mandatory for offering LayUp as a payment option, since the processing is limited to order and contact data needed for the payment plan. It becomes advisable if LayUp runs affordability or credit checks on your EU customers, or if lay by is a large share of your sales. Assess the transfer to South Africa, which has no EU adequacy decision, and keep the result with your record of processing. Confirm with LayUp which data it receives, how long it keeps it and whether it acts as an independent controller.
Sample text for your banner
When you choose LayUp at checkout, we share your name, contact details and order with LayUp Technologies in South Africa so that it can set up your lay by payment plan. LayUp processes this data under its own privacy policy, and no cookies are placed on our site for this purpose.
What LayUp sets and contacts
- Tracking method
- Server side REST API integration (api.layup.co.za) used directly or through the official WooCommerce and Magento modules: the merchant creates an order through the API, then redirects the shopper to the hosted LayUp payment widget on shopper.layup.co.za, where the shopper registers and pays a deposit and instalments. Nothing is injected into the merchant's own pages beyond the redirect; status updates come back through webhooks. The hosted widget itself loads Google gtag, Cloudflare Turnstile and the Peach Payments card checkout.
- Server location
- Operated from South Africa by LayUp Technologies (Cape Town). The websites and API are served through Cloudflare and Amazon Web Services infrastructure; the exact hosting region is not published.
- Cookieless mode available
- Yes
- Data transferred outside the EU
- Order data and shopper identity (name, email, mobile number, order amount and items) are sent to LayUp in South Africa, a country without an EU adequacy decision, and card payments are processed by Peach Payments, also South African. For EU shoppers the transfer is generally justified as necessary for the contract the shopper requested (Art. 49(1)(b) GDPR) or covered by SCC 2021/914 in the merchant agreement; check what LayUp offers. Cloudflare, AWS and Google, used on LayUp's own pages, may involve the United States.
Cookies set (2)
| Name | Type | Duration | Purpose |
|---|---|---|---|
| _ga | HTTP cookie (third party) | 2 years | Google Analytics identifier that may be set by the Google gtag script loaded on LayUp's hosted payment widget (shopper.layup.co.za). It is set on LayUp's domain only after the shopper is redirected there, never on the merchant site, and falls under LayUp's responsibility. |
| LayUp shopper session (name not published) | Local storage | Session or until logout (not documented) | Typical sign in and session state kept by the LayUp shopper web app so that the shopper can manage the deposit and instalments of a payment plan. Stored on LayUp's domain, not on the merchant site; the exact key names are not documented. |

Frequently asked questions about LayUp
Can't find your question? Write to us, we answer fast.
Which cookies does LayUp set?
None on the merchant site: the integration is a server side API call followed by a redirect. On LayUp's own hosted payment widget (shopper.layup.co.za), Google gtag, Cloudflare Turnstile and the Peach Payments checkout may set analytics and security cookies, under LayUp's responsibility.
Is consent required for LayUp?
No cookie consent is needed on your site, because nothing is stored on or read from the visitor's device there. The data shared when the shopper picks LayUp is needed to set up the payment plan, so you inform the shopper rather than ask for consent.
What is the legal basis for sharing data with LayUp?
Performance of a contract under Art. 6(1)(b) GDPR, because the shopper actively selects LayUp as the payment method. If LayUp runs credit or affordability checks, ask it how it justifies them, since that processing happens under its own responsibility.
Does LayUp transfer data outside the EU?
Yes. LayUp Technologies is based in Cape Town and card payments go through Peach Payments, both in South Africa, a country without an EU adequacy decision. The transfer is usually necessary for the contract under Art. 49(1)(b) GDPR; for systematic flows use SCC 2021/914. LayUp's sites also run on Cloudflare, AWS and Google, which may involve the United States.
Is a DPIA needed for LayUp?
Usually not, because only order and contact data required for the payment plan is shared. Consider one if LayUp performs credit scoring on EU customers or if lay by represents a large share of your sales.
How do I implement LayUp in a GDPR compliant way?
Name LayUp in your privacy notice as a South African payment provider and list the data shared. Obtain LayUp's data processing terms, confirm its role as controller or processor, and document the transfer basis. Keep LayUp out of your cookie banner and check that your theme loads no LayUp assets before checkout.
Are there EU based alternatives to LayUp?
For instalment payments in Europe, Alma and Oney (France), Scalapay (Italy) and Klarna (Sweden) are established providers that process data under the GDPR. Note that most of them deliver the goods immediately rather than after full payment, so check whether a true lay by model is what you need.
How should I update my cookie policy for LayUp?
LayUp does not need a cookie policy entry because it sets no cookies on your site. Describe it in your privacy notice instead, as a payment provider in South Africa, and link to LayUp's privacy policy for the cookies used on its hosted widget. Searches for layupcloud refer to a different Layup learning platform, so make sure you document the right service.
